§ 150.06 PRIVACY FENCES; BUILDING PERMITS.
   (A)   No new privacy fence, or any type of fence, or other action which may be regulated by the provisions of this section, shall occur without a privacy fence building permit issued by an authorized official, or his or her designee, of the city, and approved by the City Council.
   (B)   (1)   An application for privacy fence building permit, available from the city’s finance office, shall be completed by the landowner requesting the building permit. Completed applications shall be returned to the authorized official of the city for review. All privacy fence building permits shall be returned to the city’s finance office no later than one week before the regular monthly City Council meeting. Any privacy fence building permits received less than a week before the regular monthly City Council meeting will not be approved until the next month’s meeting. No work can be started until the building permit has been approved.
   (C)   To be considered complete, the application form shall be accompanied by the following additional items:
      (1)   Any required attachments and fees;
      (2)   Two copies of plans drawn to scale, showing the dimensions and shape of the lot to be built upon, exact sizes and locations on the lot of buildings already existing, if any, and the location and dimensions of the proposed privacy fence; and
      (3)   Any additional information, as requested by the authorized official of the city, as lawfully may be required to determine conformance with, and provide for the enforcement of, this section.
   (D)   One copy of the plans shall be returned to the applicant, after the authorized official of the city has marked such copy as either approved or disapproved, and attested to the same by signing said copy of the plans. One copy of the plans, similarly marked, shall be retained by the authorized official for city records.
   (E)   If the authorized official of the city determines the proposed action would not be in compliance with the provisions of these regulations, a privacy fence building permit may not be issued. Issuance of a privacy fence building permit shall indicate that, in the opinion of the authorized official of the city, the proposed use and/or alterations of the existing use are in compliance with the requirements of this chapter. Issuance of a privacy fence building permit shall not be construed as waiving any provision of these regulations. Proposed uses and/or alternations of existing uses which are not in compliance with the requirements of this chapter shall not be issued a privacy fence building permit.
   (F)   The fees, expiration of the privacy fence building permit, time limit for obtaining permits, and appeals will be the same as the Building Permit Ordinances 16-8A-2, 16-8A-3, and 16-8A-4.
