Every entity or individual selling fireworks within the city limits is prohibited from placing or setting up any temporary facility placed or erected for the purpose of selling fireworks prior to five days before the date on which firework sales are allowed by state law. Every entity or individual selling fireworks within the city limits must completely remove any temporary facility placed or erected for the purpose of selling fireworks no later than five days after to the date on which firework sales are no longer allowed by state law. For the purposes of this section, a “FACILITY” is any structure that does not conform to the city building code and has not been issued a building permit and certificate of occupancy by the city.
