Certain earth-disturbing activities with less than one acre of earth-disturbing activity not automatically subject to exemptions by Section 1333.04 may exist for which the submission of a stormwater control plan serves no real purpose or where post-construction BMPs are infeasible. Such activity shall be eligible for a waiver from post-construction BMP requirements and/or other requirements of this chapter.
To obtain a waiver, a person shall submit a written request and development plans that include sediment and erosion control measures to the City Engineering and Zoning Department. This request shall include sufficient data to determine that granting a waiver will not result in excessive stormwater runoff or rate of runoff. If a waiver is granted, submittal of a development plan, implementation of erosion and sediment control measures and plan review fees are still required. (Ord. 24-2022. Passed 6-21-22.)
