This chapter shall apply to all earth-disturbing activities performed on land used or land being developed for commercial, industrial, residential, recreational, public service or other nonfarm purposes which are within the jurisdiction of the City unless otherwise excluded within this chapter or unless expressly excluded by State law. This chapter shall not apply to the following:
(a) Public transportation, utilities and drainage improvements or maintenance thereof undertaken by a government agency or political subdivision within a dedicated or generally recognized street, road or right of way.
(b) Earth-disturbing activities involving less than 5,000 square feet.
(c) Earth-disturbing activities that result from the construction of a single family dwelling unit. (Ord. 24-2022. Passed 6-21-22.)
