951.01 UTILITY SERVICE EXTENSIONS; CONDITIONS.
   (a)   The City shall be permitted to extend the City water lines outside of the Municipality under the following conditions:
      (1)   That the property owner extending said water line shall be responsible for cost of said extension pursuant to Section 913.05;
      (2)   That the property owner shall install said tap and meters pursuant to Section 913.02;
      (3)   All plans and specifications will be reviewed by the City Engineer and be subject to his approval;
      (4)   All other conditions set forth under Chapter 913 shall apply. Rates shall be established pursuant to Section 915.02.
   (b)   All City-owned utilities, other than water, shall require annexation as follows:
      (1)   Abutting or contiguous properties outside the corporation limits. Upon the application for City utility services, other than water, the owner(s) shall file an annexation petition with the appropriate jurisdiction. The owner(s) shall also file an instrument with the deed to the property or cause to be included in the deed restriction that the property owner(s) is/are required to abide by all land use regulations and development standards of the City of Bucyrus. If the petition is not filed within sixty days, or the annexation is not being completed within one year, the City, through its Council and Administration, may at its option, terminate the utility service to the property.
      (2)   Properties which are not abutting or contiguous to the corporation limits. Owner(s) of properties not contiguous but who wish to be served by City-owned utilities, other than water, shall file an instrument with the deed to the property or cause to be included in the deed restriction that the property owner(s) is/are required to annex the property under their control to the City of Bucyrus at such time that it becomes abutting or contiguous to the corporation limits. Upon the property becoming abutting or contiguous to the corporation limits, the property owner(s) shall be notified by the City that the owner( s) is/are required to file an annexation petition with the appropriate authorities. If the petition is not filed within sixty days, or the annexation is not being completed within one year, the City, through its Council and Administration, may at its option, terminate the utility service to the property.
