929.03 RESIDENTIAL, COMMERCIAL AND INDUSTRIAL SEWER RATES WITHIN THE CITY.
   (a)   Net Rate per 100 Cubic Feet. The monthly rate for sewage services shall be as follows:
Monthly Sewer Use Rate Schedule
   The wastewater sewer use rate for each property within the City of Bryan whose premises are served either directly or indirectly by a connection to the Bryan, Ohio, sewage system shall be one dollar and eighteen cents ($1.18) per 100 cubic feet of wastewater discharged for bills rendered on or after April 20, 2022 and shall increase to one dollar and forty-five cents ($1.45) per 100 cubic feet of wastewater discharged for bills rendered on or after December 20, 2022. The
quantity of wastewater discharged shall be equal to measured water usage as determined by the Bryan City Water Department water meter therein, or by a sewage meter installed on the discharge pipe therefrom.
   (b)   Other Sewage Minimum Charges Monthly Basis. In addition to the sewer use rate per 100 cubic feet of wastewater discharged, as described in Section 929.03(a), a monthly sewage service charge based on the size of the water meter installed therein shall be charged as follows:

   (c)   Other Monthly Sewage Service Surcharge for High Strength Discharge. A monthly sewage surcharge shall be assessed for any user discharging wastewater as determined by the Bryan City Wastewater Department containing B.O.D. in excess of 260 mg/l, suspended solids in excess of 260 mg/l, or phosphate in excess of 7 mg/l as follows:
   $0.040 per pound of B.O.D. over 260 mg/l
   $0.040 per pound of suspended solids over 260 mg/l
   $16.30 per pound of phosphates over 7 mg/l
   (d)   Permits for Residential, Commercial and Industrial Connections and Disconnections to the Sewer System, and Inspection and Tap Fees. A permit shall be necessary for all residential, commercial, and industrial connections or disconnections to the sewer system. An inspection fee of thirty dollars ($30.00), and, if a tap into the sewer is necessary, a tap fee of thirty dollars ($30.00) shall be assessed for all residential, commercial and industrial connections to the sewer system. When replacement of existing sewers or retapping becomes necessary because of the sewer separation projects, a fee of ten dollars ($10.00) shall be assessed for inspection only.
   Whenever an existing tap is abandoned for any reason, a permit is required from the City Engineer's department but, no fee will be charged for the inspection of plugging.
   (e)   Terms of Payment. The rates set forth above are net and apply only in case all accounts for water service are paid within ten days from the date of bill. If not so paid, the gross rates, which are the above net rates plus ten percent (10%), shall apply.

   (f)    Other Conditions: This rate shall apply to all users as defined herein, where sewer service is available, irrespective of whether or not the premises are connected to the City's sewer system.
   Residential users who have water wells, where sewage is discharged into the City's sewer system and water is obtained from a source other than the City, shall have the choice to install at his own expense suitable metering equipment approved by the City, that shall accurately determine the amount of sewage being discharged into the City's system or to pay a sanitary sewer rate of thirty-one dollars and fifty-three cents ($31.53) per month for bills rendered on or after April 20, 2022 and thirty-five dollars and sixty-nine cents ($35.69) per month for bills rendered on or after December 20, 2022. The above rate shall apply to such metered usage.
   If the Sewage Treatment Plant Superintendent determines a portion of the water, whether supplied by the City or from some other source, used by commercial or industrial users enters the City's sewer system, one of the following billing procedures shall be applicable as determined by the Superintendent:
      (1)    The owner shall separate his plumbing so that all water discharging into the City's sewer can be properly metered. The owner shall, at his own expense, install and maintain such separate water meters as are necessary to properly determine the portion of the water used which is discharged into the City's systems.
      (2)    The owner shall install and maintain at his own expense suitable metering equipment that shall properly ascertain the quantity of sewage being discharged into the City's system.
      (3)    A sanitary sewer rate of thirty-one dollars and fifty-three cents ($31.53) per month for bills rendered on or after April 20, 2022 and thirty-five dollars and sixty-nine cents ($35.69) per month for bills rendered on or after December 20, 2022, shall be established for all commercial sewer users who have water wells.
   Other conditions pertaining to application of service, sewer taps, disconnection and reconnection of a service, responsibility for payment of bills and other conditions are provided for in the City's "General Rules, Terms and Conditions" available at the Electric and Water Department Office, which are a part of this schedule, the same as is set forth completely herein.

   (g)   Water Leaks. Upon determination of a water leak between the property owner's building foundation and the City water main, the person designated by the Utilities Director or the Operation Manager, sewage charges shall be adjusted by the Bryan City Clerk-Treasurer. The method of adjustment shall be based on the twelve month average water usage prior to the month of the water leak.
