927.01 DEFINITIONS.
   (a)   Unless the context specifically indicates otherwise, the meaning of terms used in this chapter shall be as follows:
      (1)   "Administrator" means the Administrator of the Environmental Protection Agency, or any person authorized to act for him.
      (2)   "Biochemical Oxygen Demand" (BOD) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at twenty degrees Centigrade, expressed in milligrams per liter.
      (3)   "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste, and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning three feet outside the building wall.
      (4)   "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
      (5)   "Chemical Oxygen Demand" (COD) means the equivalent quantity of oxygen used in the chemical oxidation of organic matter present in water and wastewater. Oxidation is accomplished using a strong chemical oxidizing agent in an acidic medium.
      (6)   "City" means the City of Bryan.
      (7)   "Combined sewer" means any sewer conveying both sanitary and storm flows.
      (8)   "Commercial" means a user of wastewater treatment works not in the "domestic" or "industry" classifications as defined herein.
      (9)   "Compatible pollutant" means a waste constituent which does not interfere with the operation or performance of the wastewater treatment works and plant and includes BOD, suspended solids, pH, fecal coliform bacteria, and additional pollutants identified in the NPDES Permit if the publicly-owned treatment works was designed to treat such pollutants and in fact does remove such pollutants to a substantial degree.
      (10)   "Debt charge" means a charge levied against sewer users for the recovery of all or a portion of the nongrant funded portion of the capital costs of the wastewater traetment works.
      (11)   "Domestic" means a residential user of the wastewater treatment works. Domestic wastes from industries are defined as wastes originating from sanitary conveniences. Domestic wastes do not include trade or process wastes.
      (12)   "Environmental Protection Agency" means the Federal (or United States) Environmental Protection Agency, or any person authorized to act for that agency.
      (13)   "Floatable grease" means oil, fat or grease in a physical state such that it will separate by gravity from wastewater by treatment in an approved pretreatment facility.
      (14)   "Garbage" means solid wastes from the preparation, cooking, and dispensing of food, and from the handling, storage and sale of produce.
      (15)   "Incompatible pollutant" means any pollutant which is not a compatible pollutant.
      (16)   "Industrial wastes" means the wastewater from industries, as defined herein, as distinct from segregated domestic wastes or wastes from sanitary conveniences.
      (17)   "Industry" means a manufacturing activity identified as a "Division A, B, D, E or I" industry, as defined in the office of Management and Budget's Standard Industrial Classification Manual, 1972, as amended and supplemented. However, any industry, as previously defined in this paragraph, may be excluded from the "industry" category if it discharges non-process, segregated domestic wastes or wastes from sanitary conveniences.
      (18)   "Maintenance" means upkeep and repair costs required to maintain the sewer system structures and equipment in efficient operating condition during the service life of such works.
      (19)   "May" is permissive; "shall" is mandatory.
      (20)   "mgd" means one million gallons per day.
      (21)   "mg/l" means milligrams per liter.
      (22)   "Natural outlet" means any outlet into a watercourse, pond, ditch, lake or other body of surface or ground water.
      (23)   "Nonindustrial user" means a user of the wastewater treatment works not in the "industrial user" classification, as defined herein.
      (24)   "NPDES Permit" means the National Pollutant Discharge Elimination System permit for the Bryan Wastewater Treatment Plant.
      (25)   "Operation" means any physical and mechanical actions, processes or functions required to efficiently operate the sewer system.
      (26)   "Owner" or "person" means any individual, firm, company, industry, association, society, corporation or group.
      (27)   "pH" means the logarithm of the reciprocal of the hydrogen-ion concentration.
      (28)   "Pollutant" means any noxious chemical or other refuse material or constituent that impairs the purity of water.
      (29)   "Pretreatment" means the treatment of wastewater from users before introduction into the sewer system.
      (30)   "Private sewer" means any extension of the wastewater treatment works which is not a public sewer.
      (31)   "Properly shredded garbage" means the wastes from the preparation, cooking and dispensing of food that have been shredded to such degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch in any dimension.
      (32)   "Public sewer" means a sewer in which all owners of abutting properties have equal rights, and is controlled by public authority.
      (33)   "Replacement" means expenditures for obtaining and installing equipment, accessories, or appurtenances which are necessary to maintain the capacity and performance during the service life of the treatment works for which such works were designed and constructed.
      (34)   "Residential user" means any user of the system generating domestic wastewater originating at a home or residence.
      (35)   "Sanitary sewer" means a sewer that carries liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with minor quantities of ground, storm and surface waters that are not admitted intentionally.
      (36)   "Sanitary sewer charges" means the aggregate of various components of billing charges, user charges and extra strength surcharges.
      (37)   "Sanitary wastes" means the combination of liquid and water-carried wastes discharged from sanitary plumbing facilities and conveniences by reason of normal human and domestic activities.
      (38)   "Sewer" means a pipe or conduit that carries wastewater or drainage water.
      (39)   "Slug" means any discharge of water or wastewater which in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than fifteen minutes more than five times the average twenty-four hour concentration or flows during normal operation and shall adversely affect the wastewater treatment works.
      (40)   "Storm drain" or "storm sewer" means a drain or sewer for conveying water, ground water, subsurface water or unpolluted water from any source.
      (41)   "Suspended solids" means total suspended matter that either floats on the surface of, or is in suspension in, water, wastewater, or other liquids and that is removable by laboratory filtering as prescribed in "Standard Methods for the Examination of Water and Wastewater" and referred to as nonfilterable residue.
      (42)   "Unpolluted water" means water of quality equal to or better than the effluent criteria delineated in the NPDES permit or water that would not cause violation of receiving water quality standards and would not be benefitted by discharge to the sanitary sewers and wastewater treatment facilities provided.
      (43)   "User" means any building, structure or other facility either directly or indirectly connected with the sanitary sewer system.
      (44)   "User charge" means a charge levied on users of the wastewater treatment works for the cost of operation, maintenance and replacement of the wastewater treatment works.
      (45)   "User class" means any class of users of the wastewater facilities.
      (46)   "Wastes" or "wastewater" means the spent water of a community. From the standpoint of source, it may be a combination of the liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with any ground water, surface water, and storm water that may be present.
      (47)   "Wastewater treatment plant" or "WWTP" means that portion of the wastewater treatment works required to treat wastewater and dispose of the effluent.
      (48)   "Wastewater treatment works" or "works" means the structures, equipment, parcels of land, easements and processes required to collect, carry away and treat wastewater and dispose of the effluent of the sewer users. Wastewater treatment works shall include sanitary sewers and intercepting sewers, but shall not include storm sewers.
      (49)   "Watercourse" means a channel in which a flow of water occurs, either continuously or intermittently.
