7.09 CONTRACTS AND PURCHASES
a.   The City Manager may, within the amounts and items appropriated by Council, but otherwise without specific Council approval for such purchase or contract, make purchases and enter into contracts on behalf of the Municipality involving expenditures not in excess of that amount authorized to be spent by the limitations of general State Law, except as may otherwise be provided by the Charter or ordinance of the Council.
b.   All expenditures in excess of that amount authorized to be spent by the limitations of general State Law, except as may otherwise be provided by the Charter or ordinance of the Council, shall require Council’s specific prior approval, subject to the following:
   1.   Emergency expenditures may be made without Council’s prior approval when obtaining Council’s prior approval would be impracticable and provided that such emergency expenditures are promptly thereafter presented to Council for its approval.
   2.   Non-emergency expenditures in excess of $25,000.00 shall only be authorized by Council pursuant to contract made with the lowest and/or best bidder after public advertising and receipt of bids in the manner provided by ordinance.
   3.   Regardless of the amount of same, the following expenditures may be authorized by Council without being subject to the advertisement and public bidding procedures in Section 7.09b.2. above of this Charter:
      A.   For the acquisition of real estate;
      B.   For the discharge of non-contractual claims against the City;
      C.   For professional services;
      D.   For the joint use of facilities or exercise of powers with other political subdivisions; or
      E.   For the product or services of public utilities including those Municipally and publicly operated.
