(A) Establishment. There is hereby established, pursuant to I.C. 36-10-3-22, the Brownsburg Park and Recreation Non-Reverting Operating Fund.
(B) Purpose. The purpose of the Brownsburg Park and Recreation Non-Reverting Operating Fund is to allow for collection of fees and revenue from Park Department operated vending machines, concessions, programs, facilities, partnerships, sponsorships and donations. The monies in the Brownsburg Park and Recreation Non-Reverting Operating Fund shall be used for general maintenance, for the acquisition, repair and/or replacement of capital improvements, for equipment, for other property, goods and services necessary to the operation of the Parks Department, for other related expenditures necessary for the ongoing operation of the programs and special events, and as otherwise permitted by law.
(C) Administration. The Brownsburg Park and Recreation Non-Reverting Operating Fund shall be administered and maintained by the Clerk-Treasurer as hereinafter set forth:
(1) Monies in the Brownsburg Park and Recreation Non-Reverting Operating Fund shall be kept in an account in a place and manner as directed by the Clerk-Treasurer of the Town, separate and apart from all other Town funds, and shall be invested with the interest earned thereon deposited into the Brownsburg Park and Recreation Non-Reverting Operating Fund;
(2) Fees may be established and collected by the Park and Recreation Board for activities and events held as the Board may deem necessary for those activities and events in accordance with I.C. 36-10-3;
(3) The funds held and accounted for in the Brownsburg Park and Recreation Non-Reverting Operating Fund shall be withdrawn only for the purpose of maintaining, improving and/or operating the programs and facilities of the park system;
(4) All property acquired from funds held in the Brownsburg Park and Recreation Non-Reverting Operating Fund shall be titled in the name of the Park Board; and
(5) The life of the Brownsburg Park and Recreation Non-Reverting Operating Fund shall be perpetual, unless termination is initiated by the Park and Recreation Board and subsequently enacted by the Town Council.
