935.14 SEWER RATES AND CHARGES; LATE PENALTY.
   (a)    For the payment of the proper and reasonable expense of operation, repair, replacement, improvements, additions, betterments, extensions and the maintenance of the sanitary sewer system and for the payment of the sums required to pay the principal and interest of all loans and bonds as they become due; Council shall enact and may from time to time, but no less than annually, review expenditures and revenues, and amend a schedule of just and equitable charges for the use of and services rendered by the municipal sewer system and wastewater treatment plant; which schedule of rates and charges shall be based upon the metered amount of water supplied to the premises. Revised rates shall start and be in effect from the effective date of passage by Council. Each schedule shall be maintained on file in the office of the Municipality while it is in effect.
   (b)    Rates and charges established shall be applicable to all customers served by the Municipality's sanitary sewer system. Service shall be available to all domestic, commercial industrial, institutional and governmental users.

   (c)    The following shall be the quarterly rates charged by the City for services to be rendered by its sanitary sewage system to it and to its inhabitants and others, based on water consumption. The Rate schedule shall apply effective on the March 2023 billing for sewer usage as follows on:
      (1)   Domestic strength wastewater.
         A.   First minimum charge for 1,000 cubic feet or less per quarter: Thirty-eight dollars and sixty-five cents ($38.65).
         B.   Second: Charge for each 100 cubic feet or any part thereof, in excess of 1,000 cubic feet, but less than 10,000 cubic feet: Three dollars and eighty-seven cents ($3.87).
         C.   Third: Charge for each 100 cubic feet, or any part thereof in excess of 10,000 cubic feet: Two dollars and eighty-eight cents ($2.88).
         D.   Fourth: There will be a twenty-five percent (25%) additional fee for consumers living outside of the municipal corporation limits.

      (2)    Extra-strength wastewater.
A surcharge shall be applied to all nonresidential, extra-strength wastewater dischargers. For the purpose of this surcharge, thirty percent (30%) of the user charge shall be allocated toward BOD and thirty percent (30%) towards suspended solids (ss).
The adjusted user charge shall be computed as follows:
BOD Charge = .30 x user charge X BOD   (mg/l)

SS Charge = .30 x user charge x SS  (mg/l)

Adjusted user charge = flow + BOD charge + SS charge
No users shall pay an adjusted user charge less than the minimum user charge for up to 1,000 cubic feet.
   (d)    The foregoing rates and charges for sewer service shall be billed and collected quarterly, and shall be applicable to all improved property abounding and abutting upon the sewerage system or serviced thereby for each entire year of operation, and shall not be suspended except with the approval of the Municipal Manager. The foregoing charges are minimum charges, not maximum charges, and the Municipality reserves the right and is obligated to increase the same at any time should the revenues of the system prove insufficient to pay the operating and maintenance expenses and the debt and reserve charges.
   (e)    The owner of private property which is served by the sewerage system by pipes connected with the system to convey sewerage away, shall, as well as the lessee of the premises, be liable to the Municipality for all service of the system rendered the premises.
   (f)    There will be a penalty of ten percent(10%) of the total bill for the use of the sanitary sewer system and sewage treatment plant service added to the sanitary sewer system and sewage treatment plant service bill should that bill not be paid twenty-five days after the billing date on the sanitary sewer system and sewage treatment plant service bill. Any sewer bill which has been delinquent for more than forty-five days from the date of billing shall be certified to the County Auditor and shall become a lien against the property served and shall be collected as general taxes.
   (g)    The funds derived from the collection of charges or rentals authorized by this section shall be deposited with the Director of Finance and shall be accounted for and known as the Sanitary Sewer Fund, and shall be available for the payment of costs and expenses of management, maintenance, and repair of the sanitary sewerage system, the sewage pumping, treatment, and disposal works, and any surplus in the Fund shall be used for the payment of the interest on bonds issued and outstanding or which may be issued, to provide funds with which to pay the municipal portion of the cost of construction of the sanitary sewerage system or part thereof, and the sewage pumping, treatment, and disposal works, and to retire the bonds when they mature, or for the enlargement or replacement of the sanitary sewerage system, sewage pumping, treatment, and extension of the sewerage system into unsevered areas.
    (h)    Council shall conduct an annual review of expenditures and revenues associated with the Sanitary Sewer Fund and adjust sewer service rates and charges as may be appropriate.
   (i)    Each user shall be notified at least annually, in conjunction with the rendering of a regular bill, of the current rates and portion of the sewer service charge attributable to operation, maintenance and replacement costs. This notice shall normally accompany the first bill in each calendar year.

   (j)   There shall be a ten percent (10%) discount on the quarterly sewer billing for senior citizens or permanently and totally disabled citizens who apply for the discount and qualify for the discount. To receive the ten percent (10%) discount on the quarterly sewer billing, the sewer account customer shall meet the following qualifications:
      (1)   Be 65 years old or older, or permanently and totally disabled, at the time of application; and

      (2)   Have a total household income that does not exceed thirty thousand dollars ($30,000); and

      (3)   Own or rent your residence in the City of Brookville at the time of application for the discount, and reside in that residence.
   An application for this ten percent (10%) senior citizen or permanently and totally disabled sewer discount shall be completed annually, and the applicant shall provide a copy of the current year tax return or other evidence of income deemed appropriate by the Finance Director to establish that the applicant qualifies for this discount. Upon approval of the application for the ten percent (10%) discount, the ten percent (10%) discount shall apply to the next quarterly billing after approval of the application. The ten percent (10%) discount shall continue for a period of one (1) year from the date of the application, and then the sewer consumer must reapply to continue to receive the ten percent (10%) discount.
