(A) The detention/retention requirements of this chapter shall apply to all new public and private residential, commercial and industrial developments with an area in excess of 5 acres or more than 3 lots in the town, and all other requirements of this chapter apply to all new residential, commercial and industrial developments of greater than 1,000 square feet of impervious area in the town, and all repair or rehabilitation of existing storm facilities in the town.
(B) Any residential, commercial or industrial subdivision (major or minor) or construction project thereon, which has had its drainage plan approved by the Board prior to the effective date of this chapter, shall be exempt from all of the requirements of this chapter.
