§ 92.48 ENFORCEMENT.
   If such junk or junk vehicle is not removed within five days from public property, or within 15 days from private property, after such notice, the Town Marshal, or his or her designee, shall issue a written order of violation of the section, and the violating party shall be subject to civil penalties. Enforcement shall be by the marshal service and if necessary appropriate action in the county court. The form of all notices for vehicles shall be issued pursuant to the provision of I.C. 9-22-1-11. Any person who is judged to have violated the provision of this subchapter is subject to a fine of up to $150, in addition to towing, hauling, removal and storage charges. If the fines assessed here are not paid voluntarily, the town may proceed to court for collection actions. In the event that the town is successful in court, attorney fees may also be awarded.
