(a) All development areas under active construction may be subject to external inspections by the Village to ensure compliance with the approved SWP3 or abbreviated SWP3.
(b) After each external inspection, the Village shall prepare and distribute a status report to the applicant.
(c) If an external inspection determines that operations are being conducted in violation of the approved SWP3 or abbreviated SWP3, the Village may take action as detailed in Section 1050.23.
(d) All costs associated with such inspections shall be the responsibility of the applicant and will be deducted from the fee reserve balance posted with the Finance Department.
Note: Effective control of pollutants from construction sites demands that on-site personnel work proactively. In other words, the site must be prepared to handle the problem before the problem comes about. Even though SCMs are erected at the beginning of projects, all too often their initial construction is incorrect, thereby rendering many SCMs ineffective at the time they are needed the most. By the time on-site personnel react to the failing SCMs, it is likely a significant amount of sediment has already been conveyed off-site. Brooklyn Heights should consider a requirement to have all structural SCMs inspected by a qualified representative of the Village as they are being constructed to ensure they meet minimum standards. This would eliminate many of the "violations" noted within inspection reports, and help to accomplish the overall goal-keeping pollutants on site.
