(A) Required. No theaters, exhibitions, circuses or other public shows to which admission is obtained upon payment of money, and having no permanent location, shall be exhibited publicly in this city by any person, persons, without having first obtained a license therefor from the Clerk/Treasurer in writing, signed by the Mayor and countersigned by the Clerk/Treasurer.
(B) Waiver. Any organization whose headquarters, or main offices, are located within the city, or Bronson Township, Branch County Michigan, may, by application to the City Council for the city, request a waiver of the requirements of this chapter. In determining whether or not a waiver shall be appropriate, the City Council shall consider the following factors:
(1) Is the event designed to provide profit for individuals or groups of individuals?
(2) Is the event designed to fulfill a unique cultural or educational experience for the citizens of the city?
(3) Is the unique nature of the event such that it is unlikely that any other group would present, or plan such an event.
