§ 1244.05 MAJOR SUBDIVISION; PRELIMINARY PLAN.
   (A)   Application. A written application for approval of a preliminary plan designed by a professional city planner, civil engineer or landscape architect, complying with the requirements set forth in §§ 1244.02 and 1250.03 , shall be submitted for each proposed major subdivision. The purposes of the preliminary plan are to explore the best design for the subdivision and the best relationship to adjoining subdivisions or undeveloped land, to outline a program of improvements, avoidance of environmental sensitive areas, wetland areas, streams and to obtain the advice, suggestions and requirements of the Planning Commission and departments of the city and Council before the plan becomes rigid as in a detail drawing.
   (B)   Effect of Approval. The approval of the preliminary plan by Council shall assure the developer for a one-year period from the date of approval, or, for such additional period as extended by approval of Council pursuant to § 1448.09 of the Building and Housing Code, that:
      (1)   The general layout of streets, lots and other features is approved and it shall be the basis for the preparation of the final plat;
         (a)   There shall be a natural undisturbed 25 foot buffer around the entire perimeter of the subdivision, including but not limited to the streets, lots and other features.
         (b)   All lots shall have a rear yard setback of 25 feet and a side yard setback of 25 feet. There shall be a 25 foot rear yard and ten foot side yard setback for all accessory buildings and any other structures.
      (2)   The general terms and any special conditions under which the approval of the plan was granted will not be changed unless resubmitted to the Planning Commission and Council; and
      (3)   The developer may submit drawings and specifications for improvements and a final plat for the whole or part of the subdivision.
