§ 1026.12 SHADE TREE TRUST FUND; DONATIONS.
   (A)   Establishment. There is hereby established a fund to be known as the Shade Tree Trust Fund. All gifts of money received and accepted by or on behalf of the city for the purpose of planting, maintaining, protecting, utilizing and promoting shade trees, in accordance with the decision and approval of the Shade Tree Commission, shall be paid into such Fund. In addition, all funds collected from developers pro-rated for disbursement into said Shade Tree Trust Fund, pursuant to § 1448.03 of the Building and Housing Code, as well as all compensatory payments and assessments as specified in this chapter, shall be paid into such Fund.
   (B)   Disbursement of Funds. The Finance Director shall make payments from such Fund upon the presentation of vouchers or orders therefor by the Director of Public Service, as approved by the Commission.
   (C)   Donations. The Finance Director is hereby authorized to accept, on behalf of the city, all gifts, money or other things or items of value for the purpose of planting, maintaining, removing, protecting, utilizing and promoting shade trees in accordance with the decision and approval of the Commission. However, a gift given expressly for a specific purpose shall, before the city is deemed to have accepted it, be accepted by a motion and vote of Council. If such motion to accept is rejected by Council, then such gift, if already delivered to the city, shall be returned to the donor and not accepted.
