§ 130.06 DISTURBANCE OF THE PEACE.
   Provided that the actions of a person charged with a violation of this chapter do not include or arise from activity that is part of the entire field of regulation of firearms and ammunition preempted by the state pursuant to F.S. § 790.33 and HB 45, and all future amendments and revisions thereof, as the same may be amended from time to time, whoever willfully disturbs the peace of another by violence, tumultuous or offensive demeanor, loud or unusual noise, profane, obscene or offensive language, or other conduct, calculated to provoke a breach of the peace, or by assaulting, striking, threatening or frightening another; or shall permit the same to be done upon premises in his or her possession, custody or control so that others in the vicinity are disturbed thereby, shall be guilty of a misdemeanor.
