§ 155.163 FLAG LOT(S).
   (A)   Any flag lot allowed by the Land Use Authority, as applicable, shall be deemed an exception and may only be allowed where a traditional lot layout is impractical or impossible.
      (1)    Flag lot(s) defined. A flag lot is an irregularly shaped lot with limited street frontage. Flag lots may be used for a single-family residence only. No other uses are allowed unless an accessory use, building, or structure to a single-family residence was permitted. All shared private driveways for flag lot access must have an irrevocable access agreement in place, compliant with the requirements of § 155.164.
(2)   Flag lot standards. The lot portion and access staff portion of flag lots, used in determining allowable dimensions on a flag lot.
*All flag lots are required to meet the lot size of the underlying zone without counting the access staff portion of the site (division (B) of this section).
**The access staff leading to the lot portion may not exceed the maximum length or be less than the minimum width set by division (B) of this section.

   (B)    Flag lot standards. See division (A)(2), flag lot standards, for information on how lot and staff size are to be determined:
      (1)   Minimum lot size. The minimum lot size for a flag lot shall be as required by the zoning district in which the lot is located. No portion of the lot’s staff section may be included in determining the required minimum lot size. The size of a flag lot shall be determined from the rear property line of the lot immediately adjacent that meets the minimum frontage requirement of the zoning district and including all property within the proposed lot or property lines.
      (2)   Maximum staff length. The maximum length of the lot’s staff section may not exceed 200 feet, measured from the property line of the staff section immediately adjacent to a road or street right-of-way line to the closest point the rear property line of the immediately adjacent lot, such lot meeting the minimum frontage requirement of the zoning district.
      (3)   Minimum yard (setback) requirements. The minimum yard requirements (setbacks) shall be as required by the zoning district unless modified by an adopted development agreement. The front yard shall be that portion of the lot immediately accessed by the private driveway.
      (4)   Private driveway; staff portion minimum width. The minimum width of the lot’s private driveway (staff portion) shall be 30 feet with a minimum of 20 feet being hard-surfaced and a minimum of five feet on each side of the hard-surfaced area reserved for storm water drainage and snow storage/removal. Hard surfacing shall include concrete, asphalt, brick pavers or crushed stone.

   (C)   (1)    Fire and emergency vehicle turnaround required. A turnaround, meeting the requirements of the city’s Fire Department, shall be provided on the “flag” portion of the lot.
      (2)    Owner’s responsibility and maintenance. All portions of a flag lot shall be determined to be private property. No part of a flag lot, including all private driveway maintenance, may the responsibility of the city.
      (3)   Addressing. The lot’s address, as provided by the city, shall be displayed in a prominent and visible location on both the dwelling and at the private driveway immediately adjacent to the public road or street for emergency services and deliveries.
      (4)   Garbage collection and deliveries. All garbage collection shall take place at public road or street. Garbage cans shall be brought to the road or street. Mail shall be provided at a postal box located at the road or street right-of-way or in a central box unit.
      (5)   Geotechnical report required. A geotechnical report shall be required for a flag lot either as part of the subdivision application and/or building permit application.

   (D)   A flag lot shall only be used for one single-family dwelling. No other uses, unless allowed as an accessory use, building or structure to a single-family dwelling, may be permitted on a flag lot.
