§ 155.095 SEPARATE APPLICATION PROCESS FOR NO-DEDICATION SUBDIVISIONS OF FIVE OR FEWER LOTS.
   (A)   For subdivisions proposing five or fewer lots (see division (C) below), and when no dedication of any kind is required or proposed, a no-dedication subdivision of five or fewer lots application process may be utilized. Subdivisions proposing to create more than five lots, or when any dedication of any kind is required or proposed, shall follow the separate preliminary subdivision plat and final subdivision plat application procedures provided by §§ 155.045 through 155.057 and 155.070 through 155.083 of this chapter.
   (B)   The Director, or authorized designee, shall be the Land Use Authority for all applications for no-dedication subdivisions of five or fewer lots. the following shall apply.
      (1)   A combined preliminary subdivision and final subdivision plat application shall be submitted to the Department for review and decision consistent with § 155.096 of this chapter.
      (2)   The combined preliminary subdivision and final subdivision plat. All areas of the subject property shall be located within a lot (no remnant property remains).
      (3)   No portion of the subject property is proposed or required for dedication for any public purpose(s).
      (4)   All proposed lots shall have access to required infrastructure and services and lot frontage on an immediately adjacent road or street. a no-dedication subdivision of five or fewer lots shall not cross any other private property to secure access to required infrastructure and services.
      (5)   The proposed no-dedication subdivision of five or fewer lots shall comply with all requirements of this chapter, all applicable zoning district standards, and all other applicable requirements and regulations.
      (6)   No land within the proposed subdivision shall be located within any other recorded subdivision.
      (7)   The Director, or designee, shall not consider the combined preliminary plat and final plat application until a Commission recommendation has been received.
