§ 155.074 DEPARTMENT TO DETERMINE A COMPLETE FINAL SUBDIVISION PLAT APPLICATION.
   (A)   Within 30 calendar days following the final subdivision plat application being filed with the Department, and prior to the final subdivision plat application being scheduled with the Land Use Authority, as applicable, the Department shall determine and find that the final subdivision plat application is complete and contains all the information and materials required for a complete final subdivision plat application, as required by § 155.073 of this chapter. The Department shall only determine a final subdivision plat application complete when the application is provided in a form that complies with all the requirements of § 155.073 of this chapter, and all applicable fees have been paid. The Department shall notify the applicant, in writing, of the result of such determination. Following a determination of a complete final subdivision plat application, the Department shall schedule the final subdivision plat application at a duly noticed meeting of the Land Use Authority.
   (B)   A final subdivision plat application lacking any of the final subdivision plat application materials required by § 155.073 of this chapter shall be cause for the Department to determine the final subdivision plat application incomplete. The Department shall notify the applicant, in writing, of the information lacking from the final subdivision plat application. The Department shall allow a maximum of 30 calendar days from the date of written notification to the applicant(s) for the information lacking to be provided and a determination of a complete final subdivision plat application to be made by the Department. If the final subdivision plat application remains incomplete after 30 calendar days from date of written notification to the applicant(s), the Department shall return the entire incomplete final subdivision plat application to the applicant(s), including any final subdivision plat application review fees paid.
   (C)   A determination of an incomplete final subdivision plat application by the Department shall prohibit the Department from scheduling the item on any Land Use Authority meeting.
   (D)   Any person aggrieved by a decision of the Department related to a determination of application completeness may appeal the decision to the Commission, the Commission acting as the appeal authority for determinations of application completeness decisions.
   (E)   An appeal of a determination of final plat application completeness or incompleteness shall comply with all requirements and standards of §§ 155.240 through 155.245 of this chapter.
