§ 155.046 LAND USE AUTHORITIES AND PRELIMINARY SUBDIVISION PLAT APPLICATION TYPES.
   (A)   City Council; preliminary plat applications for ten or more lots, or when any dedication(s) for any purpose(s) is involved. The Council shall be the Land Use Authority for all preliminary plat applications proposing the creation of ten or more lots, or when dedication(s) of any kind is proposed or required. The Council shall not consider a preliminary plat application until a Commission recommendation has been received.
   (B)   Department Director.
      (1)   Preliminary plat applications for nine or fewer lots and no dedication involved. The Director or an authorized designee (“designee”) shall be the Land Use Authority for all preliminary subdivision plat applications proposing nine or fewer lots and when no dedication(s) of any kind is/are proposed or required. The Director, or designee, shall not consider a preliminary plat application until a Commission recommendation has been received.
      (2)   Combined preliminary/final, no-dedication subdivision of five or fewer lots. The Director, or designee, shall be the Land Use Authority for all applications for combined preliminary/final, no-dedication subdivisions of five or fewer lots. The Director, or designee, shall not consider a combined preliminary/final, no-dedication subdivision of five or fewer lots application until a Commission recommendation has been received.
