347.01 OVERSIZE OR OVERWEIGHT VEHICLES.
   (a)   Maximum Weights on Streets.
      (1)   No person shall operate any vehicle having a gross weight, including load, of more than 12,000 pounds, upon or over any street or alley of the City; provided, however, that this article shall not apply to nor include any streets forming a part of, or connecting link in, the primary road system of the State; and further provided, that the gross maximum weights permitted on any street may be further limited at the discretion of Council.
      (2)   Limitations as to weight herein imposed for streets shall be designated by appropriate traffic-control signs placed on the streets and alleys affected thereby. (1976 Code Sec. 18-127)
   (b)   Vehicles Operated by City or Under Franchise. The weight limitations imposed by subsection (a) hereof shall not apply to any vehicle operated by the City nor to any vehicle operated under and in accordance with any franchise or permit granted by the City.

   (c)   Special Permit; Bond.
      (1)   The Manager may, in its discretion, upon application in writing and good cause being shown therefor, issue a special permit authorizing the applicant to operate or move a vehicle of a weight exceeding the maximum provided in this article upon any street or alley in the City except streets forming a part of or connecting link in the State primary road system or any interstate highway. Any conditions for or limitation upon the operation of any vehicle necessary to assure against undue damage to any such street or alley may be imposed upon the issuance of such permit. No person shall violate any terms or conditions of such permit and such violation shall be grounds for revocation of the permit by the authority granting it.
      (2)   As a further condition for the granting of any special permit authorized in subsection (c)(1) hereof, the Manager or the officer issuing the permit may require the applicant to enter into bond, in such penalty and with such surety as the Manager or such officer shall deem sufficient and conditioned to save the City harmless from any damage which the City might sustain or incur from any operation by applicant which would be destructive of or by means of heavy loading or unusual traffic should damage any street in the City to such an extent that the cost of repairs or maintenance thereof would be more than the average cost of repairs or maintenance of other streets of like type and construction in the City.    (d)   Excessive Cost of Repair. Notwithstanding compliance with all other provisions of this article, whenever any person has damaged or is likely to damage, by means of heavy loading or unusual traffic, any street to such an extent that the cost of repairs or maintenance will be more than the average cost of repairs or maintenance of other streets of like type and construction in the City, the Chief of Police shall have power to further regulate the loading of such vehicles and to assess the excessive cost of repairs and maintenance of such streets against the person causing such damage and require the payment thereof before further use of such streets by such person is permitted.
