901.11 DEDICATION AND ACCEPTANCE OF STREETS, ROADS AND ALLEYS POLICY.
   (a)   Creation of Public Streets, Alleys or Roads By Purchase or Condemnation. The City may lay out and create a public street, alley, or way, by purchase or condemnation by and through action taken by the governing body of the City by ordinance.
   (b)   Creation of Public Streets, Alleys or Roads By Dedication and Acceptance. The recording of a plat or map showing streets, alleys, and roads constitutes a private dedication and such private dedication creates no proprietary rights of the general public and the City has no responsibility for the repair, maintenance and upkeep of such platted streets, alleys, or roads. The private dedication of streets, alleys, or roads through the recording of a plat showing those streets, alleys, or roads becomes a public street, alley or a road only by acceptance of the City either express or implied. The City, by formal action of the governing body, by resolution, ordinance, or by approval by notation upon the plat of the streets, alleys or roads, will be deemed to expressly accept the dedication and the City will assume responsibility for the maintenance and repair of the streets, alleys and roads so accepted. Acceptance by the City of a privately dedicated street, alley, or road may be implied by act of the City by assuming maintenance and repair and expending public funds for the upkeep, improvement, repair, or maintenance of the platted street, alley or road, at which time the City will assume responsibility for such maintenance and repair and attendant liability with respect to the accepted street, alley or road.
   It is the policy of the administrative staff of the City of Bridgeport that no maintenance, repair, improvement, or other expenditure of public funds shall be performed or made upon any platted street, alley or road not heretofore accepted without formal action of the governing body. All plats approved in accordance with the subdivision or zoning regulations of the City of Bridgeport shall bear a notation that the acceptance is as to form and that such approval does not constitute acceptance of the street, alley, or road as a public way and the City therefore has no responsibility for the maintenance, upkeep, and repair of the streets, alleys or roads shown upon the plat or map without formal action by the governing body. The private dedication of streets, roads, or alleys may be formally rejected by the City by procedure adopted by the governing body, in which case such privately dedicated streets, roads, and alleys shall not become public streets, roads, or alleys and shall not be shown on official City maps.
   Unless otherwise approved by Council, all streets are to be built in compliance with the City of Bridgeport's Design and Construction Standards.
   Roadway plans shall require approval by the City Engineer prior to construction. City inspection is to be performed during construction to monitor the quality of work and the adherence to design plans.
   Dedication requests shall be accompanied by a final as-built survey, plat, and full description of the street/roadway/alley and total easement to be dedicated.
   The City Engineer or designee shall inspect the street/roadway/alley upon the request for dedication and shall submit a report to the Governing Body as to the suitability for acceptance.
   The City shall only maintain, repair, and improve streets, roads, and alleys which are shown upon an official map of all streets, roads, and alleys in the City, which official map shall show all streets, roads, and alleys heretofore either expressly or impliedly accepted by the City.
