(a) Violation of this article shall constitute a strict misdemeanor and upon conviction shall be fined not less than one hundred dollars ($100.00) and not more than one thousand dollars ($1,000.00) per occurrence provided that:
(1) No person shall be found in violation of Section 546.05(a)(2) unless the City proves by a preponderance of the evidence that the abatement measures were reasonable and warranted and proves beyond a reasonable doubt that the defendant knowingly failed to implement them.
(2) A person may be found in violation of Section 546.05(a)(1) regardless of whether an Order of Abatement is issued.
(3) A person may be found in violation of Section 546.05(a)(2) only after an Abatement Order has been issued.
(b) Each day that such violation continues shall be considered a separate and distinct offense. (Passed 10-28-19.)
