(A)
The Village Clerk-Treasurer is hereby directed and authorized to take all the steps necessary or appropriate, in accordance with R.C. § 5705.13 and the State Auditor’s Office, to create a village fund to be designated the Sidewalk Improvement Fund.
(B) The source of revenue deposited into the Sidewalk Improvement Fund shall be a quarterly transfer of $3,000 from the General Fund, and said funds shall be used for the maintenance, repair, and replacement of sidewalks within the village that are damaged by trees planted within village right-of-way. Said funds, if available, shall be the first used for the maintenance, repair, and replacement of sidewalks within the village that are damaged by trees planted within village right-of-way. Funds in the Tree Fund shall not be used for the maintenance, repair, and replacement of sidewalks within the village that are damaged by trees planted within village right-of-way unless and until all funds in the Sidewalk Improvement Fund are depleted.
