§ 70.028 REPORTING ACCIDENTS.
   (A)   The driver of a vehicle involved in an accident resulting in property damage or injury to or the death of any person shall immediately, by the quickest means of communication, give notice of such accident to the Police Department if such accident occurs within the town.
   (B)   The driver of a vehicle which is in any manner involved in an accident resulting in property damage or injury to or the death of any person shall, within five days after such accident, forward a written report of such accident to the Police Department or a copy of any report he or she is required to forward to the State. The provisions of this division (B) shall not be applicable when the accident has been investigated at the scene by a police officer while such driver was present.
   (C)   Whenever the driver of a vehicle is physically incapable of giving immediate notice of an accident as required in this section and there was another occupant in the vehicle at the time of the accident capable of doing so, such occupant shall give, or cause to be given, the notice not given by the driver.
   (D)   Whenever the driver is physically incapable of making a written report of an accident as required herein and such driver is not the owner of the vehicle, then the owner of the vehicle involved in such accident shall, within five days after learning of the accident, make such report not made by the driver.
