If an emergency occurs necessitating a cut or excavation of any public street and it is not feasible for the person or utility to apply for and be issued a street cut permit for the reason that the public health and safety is in jeopardy or the Clerk-Treasurer's office is not open for business, the person or utility may proceed with the act or excavation and obtain a permit during the next day the Clerk-Treasurer's office is open for business.
