For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
PUBLIC UTILITY. Any individual, firm, partnership, association or corporation registered with and under the jurisdiction of the Public Service Commission of Indiana which provides for the production, transmission, delivery or furnishing of heat, light, water or power; or for the collection, treatment, purification and disposal in a sanitary manner of liquid or solid wastes, sewage, night soil and industrial waste; or provide for the conveyance of telegraph or telephone messages, but specifically excludes municipally-owned and operated utilities of the city.
RECLAMATION. The repair or replacement of a public street in as good or better condition as it was prior to any cut or excavation, and in a manner so as to prevent, as much as possible, future subsidence of the street surface in the area of the cut.
STREET CUT or EXCAVATION. Any cut of the surface material of any public street under the control and jurisdiction of the city, plus any digging and removal of surface and sub-surface material of and below the street.
