(A) The permit authorized in § 153.10 above shall be issued by the City Clerk-Treasurer on the order of the Council.
(B) Before the Clerk-Treasurer shall issue any permit so to obstruct any street or alley with building material, the person applying for the same shall file with the Clerk-Treasurer an indemnifying surety company bond payable to the city with surety to be approved by the Clerk-Treasurer.
(C) The bond shall have a condition that the person applying for the permit will pay any judgment that may be obtained against the city for damages of any kind to any person or property resulting from the obstruction or occasioned thereby, and will save the city harmless on account of any damages or judgment and will defend at his or her own expense any suit that may be instituted against the city for any damages, or for any cause growing out of any obstruction.
