It shall be a defense to prosecution for a violation of this chapter when the owner/operator of an establishment, or any employee, officer, agent or representative thereof, or the person in charge of or overseeing a public place, promptly notified the Police Department that a minor was present on the premises of the establishment during the restricted curfew hours and refused to leave.
