1339.04 APPLICATION FOR CERTIFICATE; PLANS.
   (a)    Any owner who desires to construct or erect a satellite dish-type "earth station" may apply to the Commissioner of Buildings for the permit referred to in Section 1339.02(a) herein. A part-owner, occupant or renter must have written permission from the owner of the lot, premises, or parcel of land within the Village on which such construction or erected satellite station is proposed.
   (b)    The applicant shall submit the permit application upon forms provided by the Commissioner of Buildings along with a plot plan of the lot, premises or parcel of land, showing the exact location of the proposed "earth station" and the location of all buildings on the subject lot; a description of the kind of "earth station" dish proposed; and three complete sets of construction plans, specifications and elevations of the proposed location with sufficient details to show the method of assembly and construction. Each set of plans and specifications shall show the complete name and address of the subject property owner and the complete name and address of the person who prepared the plans and specifications. The application shall indicate the owner or owners of the subject property, the occupant of the subject premises and the contractor or other person who will be permitted to construct or erect the proposed satellite dish "earth station". All construction plans shall be certified with a Professional Engineer's stamp. However, a resident who proposes to construct the "earth station" by himself shall not be required to have his construction plans certified by a Professional Engineer. This exemption shall in no way apply to any other provision of this chapter.
   (c)    The Commissioner of Buildings must notify by certified mail adjoining property owners of the proposed "earth station" site. The notice shall state that the adjoining property owner may register objections to the proposed “earth station” at the meeting of the Planning Commission at which the application is reviewed. Such notice shall be served not less than ten days prior to such meeting.
   (d)    The Commissioner of Buildings shall review the submitted application and shall note thereon whether all of the requirements of this chapter have been satisfied.
   (e)    Once the requirements of this chapter have been satisfied, the application shall be referred to the Board of Zoning Appeals, which shall have the final authority to grant or deny approval.
