The permit specified in Section 1339.02(a) shall not be required for the construction of an "earth station" with a diameter of less than three feet. However, if such an "earth station" is to be constructed on the roof of any structure, the person proposing such an installation shall obtain a building permit from the Commissioner of Buildings as specified in Section 1339.01. The Commissioner of Buildings may require the submission of construction plans in order to ensure the stability and safety of the proposed installation. The provisions of this chapter shall not apply to an "earth station" with a diameter of less than three feet, except for Section 1339.05(a).
