§ 50.01  MANDATORY USER SERVICE FEE; DISCONTINUANCE; NOTICE PROCEDURE.
   (A)   (1)   A mandatory monthly municipal utilities user service fee shall be charged to all residential and commercial customers for municipal water, sewer and solid waste collection services.
      (2)   The municipal utilities user service fee shall be collected as a unit.
      (3)   Partial payments may be accepted.

   (B)   (1)   Municipal utilities user service fee bills shall be due on the first day of each month and shall be payable by the fifteenth day of each month at the office of the Municipal Clerk. Bills not paid by the fifteenth of the month in which they are due shall be deemed to be delinquent. Upon being deemed to be delinquent, the Municipal Clerk shall give written notice to the customer of such delinquency and shall demand payment immediately.
      (2)   Upon any water and sewer service bill being deemed to be delinquent, the Municipal Clerk shall send a shut-off notice by mail warning that service shall be discontinued within seven working days from the date of the shut-off notice. It shall be the duty of the Utilities Superintendent to cut off water and sewer services on the specified date if no payment is received by the Municipal Clerk. If the delinquent customer is a known welfare recipient, it shall also be the duty of the Municipal Clerk to notify the state’s Department of Social Services of the proposed termination. Prior to the discontinuance of service to any domestic subscriber, the domestic subscriber upon request shall be provided a conference with the governing body. The governing body shall notify the domestic subscriber of the time, place and date scheduled for such conference. Whenever the municipality shall discontinue service to a domestic subscriber for non-payment of a past due account, the Municipal Clerk shall assess an additional fee to compensate the municipality for costs incurred to restore the services during regular working hours. The fee, established by the Board of Trustees, in on file in the Clerk’s office.
      (3)   Procedures for collection of any past due accounts for municipal solid waste collection are specified in §§ 51.17 and 51.18 of this code of ordinances.
      (4)   Any water and sewer and solid waste collection fee payment deemed delinquent, as defined herein, may be collected by the municipality as a civil action against the municipal customer, or may be collected by the municipality by any other method allowed by law.
