§ 20-105  COLLECTION OF GARBAGE AND RUBBISH.
   The Supervisors of the Township shall institute a regular system of collection of garbage and rubbish within the confines of the township, and provide for specific collections thereof at specified times, in accordance with the power set out herein to make regulations with respect thereto. The collection of garbage and rubbish shall be limited to three bags.
      A.   All garbage and rubbish accumulated in the township shall be collected, conveyed and disposed of by the township, and the cost of such service shall be paid as provided for in § 20-106 by the person producing the refuse or responsible for the existence or disposal thereof. Nothing in this Part shall be construed to prevent or prohibit any person engaged in the business of farming from maintaining a manure pile upon which may be thrown garbage or rubbish. Nothing in this Part shall be construed to prevent or prohibit any person from burning rubbish on his or her premises unless such burning constitutes a nuisance or is otherwise contrary to applicable law.
      B.   If any person shall convey or dispose of garbage or rubbish without utilizing the services of the township or obstruct the township’s collection, conveyance and disposal of garbage or rubbish, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
