The Police Department of the city is hereby given the power and duty of enforcing the provisions of this article and shall have the power to make lawful arrests for the violation of the provisions hereof; and to prosecute offenders. In case a violation is not committed in the presence of a member of the Police Department or cannot be detected by observation of such member, he or she may require an affidavit of any complaining person with assurance that such complaining witness will appear to testify at the trial before making any arrest.
