(A) Minors obtaining tobacco.
(1) It shall be a violation enforceable through such Violations Bureau for a person less than 18 years of age to:
(a) Purchase tobacco;
(b) Accept tobacco for personal use; and
(c) Possess tobacco on his or her person.
(2) It is a defense to such violation if the accused person acted in the ordinary course of employment in a business concerning tobacco.
(1) Any violation shall require the payment of a fine in an amount not to exceed $50 for the first violation of such ordinance, however, such fine shall automatically be reduced to $25 if it is paid to the Clerk within 72 hours of when the ticket for such violation might issue.
(2) Any ticket issued to any person for a subsequent violation of this division (A) shall require the payment of a fine of $100; however, such fine shall automatically be reduced to $50 if it is paid to the Clerk within 72 hours of when the ticket for such subsequent violation(s) might issue.
(3) A charge of $50 shall be added to any ticket issued pursuant to such ordinance where the Town’s Attorney is required to send a demand letter to any party receiving such ticket.
(4) The Clerk-Treasurer shall also add any costs associated with the enforcement of this division (A), such as certified mail postage, and the like, to the amount of the fine charged for said ticket.
(B) Unlicensed solicitation. Unlicensed solicitation shall be a violation handled by the town’s Ordinance Violation Bureau.
