(A) It shall be unlawful to discharge or use any kind of fireworks, pyrotechnic devices or tracer ammunition within the town. Each separate firework or device used will constitute a separate offense.
(B) Open fires are allowed so long as they are confined to an improved stone or metal lined fire pit or if pre-approved by the Town Council and directly supervised by the Town Fire Department. Otherwise, open fires are not allowed.
(C) It shall be unlawful to smoke outdoors in the town, except on a surface cleared of vegetation or other flammable material.
(D) Each offense shall constitute a Class B misdemeanor.
(E) The restrictions listed in this section are in effect each year from June 1 to Oct 31. The Boulder Town Council may, however, make these and/or other restrictions effective at other times during any year by passing an appropriate ordinance or resolution. Such should not be construed as a permanent amendment to this section unless the same is clearly set forth by ordinance.
