1313.03 ADDITIONS, INSERTIONS, DELETIONS, AND CHANGES TO MODEL CODE.
   The following sections of the model code document specified in this chapter are hereby revised as follows:
   (a)   Section 101.1 Replace [NAME OF JURISDICTION] with “the Village of Boston Heights, Ohio”.
   (b)   Section 102.3 Replace in its entirety with:
102.3 Application of other codes: Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the building codes and procedures specified by Chapter 1303 of these Codified Ordinances. Nothing in this code shall be construed to cancel, modify or set aside any provision of the Planning and Zoning Code”.
   (c)   Section 103 entitled Department of Property Maintenance and Inspection shall be retitled:
      "Section 103 Code Official and Fees";
Delete Sections 103.01, 103.2, and 103.3 from the model code document.
Insert the following new sections:
"103.1 Code Official: The Code Official is defined as the person or persons designated by Section 1313.05 of these Codified Ordinances to enforce the Property Maintenance Code."
      "103.2 (deleted)"
      "103.3 (deleted)"
In Section 103.5, replace [APPROPRIATE SCHEDULE] with "Fee Schedule as established pursuant to Section 1303.03 of these Codified Ordinances."
   (d)   Section 107. Add the following new sections:
“107.7 Board of Nuisance Abatement:” At the direction of the Mayor, alleged violations of Chapter 1379 of these Codified Ordinances shall be referred to the Board of Nuisance Abatement as specified in Chapter 1379 of these Codified Ordinances, in which case the procedures of that chapter shall apply to further remedial action by the Village”.
   (e)   Sections 111.2 through 111.6. Replace in their entirety with:
“111.2 Appeals Board: The Village Board of Zoning Appeals shall act as the appeals board for this section under the rules of Section 1379.04 of these Codified Ordinances, and the time allowed to make an appeal of the decision of the code official shall be the same as that allowed for other appeals to the Board as prescribed by Section 1145.03 of these Codified Ordinances. In considering such appeals, the Board shall follow its usual regulations and rules of procedure”.
   (f)   Section 302.4. Replace in its entirety with:
“302.4 Weeds: Weeds, Grass and Vegetation maintenance will be regulated by the provisions of Section 521.12 of these Codified Ordinances”.
   (g)   Section 303.2 entitled “Enclosures”. Replace in its entirety with:
“303.2 Enclosures: Swimming pools, hot tubs and spas, shall be enclosed in the manner promulgated in Chapter 1386 of these Codified Ordinances”.
   (h)   Section 304.14: Insert:
“April 1" as the first date and “October 31" as the second date.
   (i)   Section 507.1 entitled “General”. Replace in its entirety with:
“507.1 General: Drainage of roofs, paved areas, and open areas where the natural topography has been altered, shall not be discharged in a manner that creates a public nuisance.”
   (j)   Section 602.2: Change:
      “68F (20C)” to “65F (18C)”, and delete Exception in its entirety.
   (k)   Section 602.3: Insert:
      “October 1" as the first date and “May 1" as the second date, and change “68F (20C)” to “65F (18C)” and delete Exception 2 in its entirety.
   (l)   Section 602.4: Insert:
“October 1" as the first date and “May 1" as the second date.
