For the purposes of this chapter, the following terms, phrases, words, and derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future tense, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory. Words used throughout this chapter, but not defined herein or in chapter 1, article A of this title, shall have their plain, ordinary, and common meaning. Words in any gender shall apply to the feminine, masculine, and neuter genders.
ADA COUNTY HIGHWAY DISTRICT ("ACHD"): | The single countywide highway district, as provided under Idaho Code Title 40, that has exclusive jurisdiction over the public rights-of-way in the City. |
BLOCK FACE: | The two (2) sides of a City street bounded by intersecting streets, roadways, cul-de-sacs, dead ends, or other geographic boundaries. |
CITY COUNCIL: | The City Council of Boise City, State of Idaho. |
CITY OFFICIAL: | A City representative, department, or division with the authority to enforce the rules and regulations set forth within this Code, including, but not limited to, the Parking Services Office, City Clerk's Office, Code Compliance and Community Resources Office, the Boise City Police Department, or the Boise City Fire Department. |
DOWNTOWN: | The section of the City shown in the downtown area map provided in this chapter. |
EXEMPTED PERMITTEE: | A regular valet parking operation holding a current and valid permit that was first issued by the City prior to October 1, 2023, and has since not been abandoned, revoked, or expired. |
HOTEL: | An establishment containing six (6) or more separate bedrooms, in which overnight lodging is offered to the public for compensation for a period of thirty (30) days or less, primarily for the accommodation of transient guests. Such establishments may also contain ancillary services such as conference rooms, restaurants, bars, gift shops, recreational facilities, etc. For the purposes of this chapter, a hotel does not include short-term rentals as defined and regulated under Title 3, Chapter 22 of this Code, bed and breakfasts, boarding houses, shelter homes, or any other facility that is separately permitted under Title 11 of this code. |
MOTOR VEHICLE: | Every vehicle that is self-propelled, but excludes all vessels that are solely solar or human-powered and electric or motorized personal assistive mobility devices and wheelchairs. |
PARKING SERVICES OFFICE: | The Boise City Parking Services Office, or its designee. |
PARKING SPACE: | The area on or adjacent to the public roadway in which to stop, stand, or park a motor vehicle, which may be designated by lines or other markings, and if not marked, each individual space is measured in twenty-two feet (22') segments. |
PERMITTEE: | A person who holds a valet operation permit under this chapter to operate a valet parking service, and includes any of the permittee's employees, agents, representatives, or subcontractors. |
REGULAR VALET OPERATION: | A valet parking service that is operated on a daily or regularly scheduled basis by a permitted operator, which includes those operations exempted from the hotel limitation. A Regular Valet Operation must obtain a City-issued Regular Valet Parking Permit to operate in the City. |
STREET: | The entire width between the boundary lines of every public way for vehicular travel use, with jurisdiction extending to the adjacent property line, including sidewalks, shoulders, berms, and rights-of-way not intended for motorized traffic. |
TEMPORARY VALET OPERATION: | Any nonrecurring valet parking service that is operated for seven (7) consecutive days or less. A Temporary Valet Operation must obtain a City-issued Temporary Valet Parking Permit to operate in the City. |
VALET ATTENDANT: | A person hired by a valet parking service operator who may operate a valet customer's motor vehicle between the valet parking zone and the valet parking facility. |
VALET PARKING OPERATOR ("OPERATOR"): | Any person engaged in the business of providing valet parking services. |
VALET PARKING OPERATION: | A business providing valet parking services, regardless of whether a charge is levied, within the downtown area as shown in the downtown area map set forth in this chapter, independently, or under contract to the business or organization for which the vehicles are being parked, or as a hotel for its own patrons. It does not include operators of public or private off-street parking operations or facilities where customers park their own vehicles and remove the key themselves. |
VALET PARKING PLAN: | A written plan describing the location where a valet parking operation will be performed, the off-street parking location at which vehicles will be parked, and the number of parking spaces available and not required for off-street parking requirements under the Development Code. |
VALET PARKING SERVICE: | A parking service provided to accommodate patrons of a hotel or an exempted or temporary valet permittee, which service is incidental to the hotel or the exempted or temporary valet permittee's business, residence, or function and by which an attendant on behalf of the hotel or the exempted or temporary valet permittee takes temporary custody of the patrons' motor vehicle and moves, parks, stores or retrieves the vehicle for the patrons' convenience. |
VALET PARKING SIGN: | A temporary or permanent sign approved by the City, which designates the location and hours of an authorized valet parking operation. |
VALET PARKING ZONE: | The public right-of-way area where patrons of a business offering valet parking services may disembark their vehicles. |
VALET PERMIT: | A current and valid permit issued by the City to a parking service operator pursuant to the provisions of this chapter. |
VALET SPONSOR ("SPONSOR"): | Any person who signs a statement that a need for valet service exists, and who seeks to operate, or causes to be operated, a valet parking operation at the sponsor's downtown place of business, residence, or function. A valet sponsor and operator may be the same person so long as the valet parking service is solely for the sponsor's business.
