§ 93.08 DISTANCE OF TREES FROM CURBS AND SIDEWALKS.
   (A)   Street trees may be planted in any right-of-way of the village including those areas between the curb or curb line of any street, alley or public way and a sidewalk in accordance with the regulations established by the Tree Commission. Any planting in violation of a regulation of the Tree Commission shall be deemed a violation of this chapter.
   (B)   In establishing distance of trees from curbs and sidewalks for street trees, the Tree Commission shall require at least the following minimums:
      (1)   Small tree species, two feet of space between the small tree and both the curb or curb line and sidewalk (minimum four foot tree lawn);
      (2)   Medium tree species, three feet of space between the medium tree and both the curb or curb line and sidewalk (minimum six-foot tree lawn); and
      (3)   Large tree species, four feet of space between the small tree and both the curb or curb line and sidewalk (minimum eight-foot tree lawn).
   (C)   The Tree Commission may grant permission to plant at variance with its regulations in writing by majority affirmative vote of the Commission.
