§ 114.007 REMOVAL FOR VIOLATIONS.
   (A)   Any newsrack located in violation of any provision of this subchapter is subject to removal by the city only after the owner thereof has been given the opportunity for a pre-removal hearing. Prior to removal, the Building Department shall give notice by mail addressed to the owner, which notice shall state why the newsrack is in violation and give the owner seven days to remedy the violation. The owner, within this period, may request a hearing before the Judiciary Committee and present evidence to the effect that no violation exists. If the Judiciary Committee determines that a violation does exist, then the owner shall have seven days to remedy the violation after which the newsrack is subject to removal by the city. If the owner fails to request a hearing, then the city may remove the newsrack.
   (B)   The city may cause the immediate removal of any newsrack not located in a permitted position which creates an imminent danger of personal injury or property damage to the public.
