(A) In every application for a newsrack, the applicant shall provide a color photograph of the newsrack and list the dimensions of the newsrack.
(B) The applicant shall also agree to the following conditions:
(1) Any and all costs related to the installation and maintenance or removal of the newsrack shall be incurred by the applicant;
(2) The privileges granted to the applicant are non-transferable;
(3) Upon the removal of a newsrack, the permittee shall restore the property where the newsrack was located to the condition of the property prior to the installation of the newsrack, normal wear and tear excepted;
(4) Each newsrack shall be fully enclosed and shall secure the materials contained therein so as to prevent the materials from potentially littering public property;
(5) Each newsrack shall be maintained in a neat and clean condition and in good repair at all times;
(6) Each newsrack shall have affixed to it, in a readily visible place so as to be seen by anyone using the newsrack, a notice setting forth the name and address of the permittee and a telephone number of a working telephone service to call to report a malfunction; and
(7) Each newsrack shall not be used for advertising signs or publicity other than advertising for the newspaper or news periodical dispensed therefrom.
