(A) It shall be unlawful for any person to place, own, maintain or operate a newsrack located on city property within the corporate limits of the city; except that, a newsrack may be placed, owned, maintained or operated after a permit has been granted. A newsrack may be placed, owned, maintained or operated only in C-1 and C-2 Zoning Districts. Application for a permit shall be made on forms supplied by the Building Department.
(B) No newsrack may be located or placed:
(1) Within 15 feet of any fire hydrant or fire hose connection;
(2) Within 15 feet of any intersecting pavement or driveway;
(3) Within five feet of any marked crosswalk;
(4) In a flower bed;
(5) On the pavement;
(6) Where it reduces the width of the sidewalk or other paved portions of the parkway available for passage to less than five feet;
(7) Within ten feet of any door of a building;
(8) On the sidewalk or parkway on the same side of the street and immediately adjacent to a no parking zone or a no standing zone;
(9) On or in any handicapped access ramp;
(10) Fronting the curb line of Western Avenue;
(11) In a group containing more than four newsracks; and/or
(12) Within 200 of any other newsrack or group of newsracks on the same side of the street in the same block.
(C) No newsrack shall exceed 50 inches in height as measured from the ground to the highest portion of the newsrack. No newsrack shall exceed 24 inches in width as measured across the front portion of the newsrack. No newsrack shall exceed 20 inches in depth as measured from the front of the newsrack to the rear of the newsrack. The front and rear panels shall be of the same width and height. The side panels shall be of the same width and height.
(D) All applications shall be granted or denied within 30 days after receipt thereof. Upon the initial granting of a permit, the application shall pay $20 permit per location. The permit shall be automatically renewable upon the payment of a $10 annual permit fee; provided that, the location of the newsrack complies with this section. If an application for a permit required by this subchapter is denied, the applicant shall be notified and may request a review by submitting a written request within seven days from the notice of denial to the Judiciary Committee.
