§ 72.03 PARKING VEHICLES FOR SALE PROHIBITED.
   (A)   No person shall park any vehicle upon any street, public parkway or private property for the purpose of displaying it for sale, unless the property owner holds a valid business license or a used motor vehicle sale license from the City of Blue Island, which authorizes the sale of vehicles.
   (B)    Definition. USED MOTOR VEHICLE SALES means any sale, or offer for sale of any motor vehicle, by any person, firm or corporation, at a residence, dwelling or other residential location situated in the city when the sale is advertised in any manner as a used car sale, vehicle for sale, vehicle sale, car sale and the owner or occupant of the residence, dwelling or other residential location is not otherwise licensed to sell personal property from said location.
   (C)   License required. No person, firm or corporation shall conduct a used motor vehicle sale within the city unless a business license or used motor vehicle sale license is issued permitting the sale. Each used motor vehicle sale license will be valid for a period of not more than 60 consecutive days. The used motor vehicle sale license shall be displayed in a prominent place on the used motor vehicle so that it is visible from the exterior of the vehicle.
   (D)   Conditions of license issuance. No license required by § 72.03(C) shall be issued unless there is full compliance with the following terms and conditions.
      (1)   The applicant for the license shall be the owner of the premises where the sale is conducted;
      (2)   The applicant for the license shall have a current valid city vehicle sticker;
      (3)   The applicant for the license shall have a current valid vehicle registration with the State of Illinois;
      (4)   The sale of a used motor vehicle shall only involve motor vehicles owned by the applicant or members of his or her household;
      (5)   The used motor vehicle for sale shall only be parked on an improved surface;
      (6)   No items for sale shall be located. and no sales activities shall be conducted on any public sidewalk, parkway area or other public property;
      (7)   All signs advertising the sale shall be located in a prominent place on the used motor vehicle so that it is visible from the exterior of the vehicle;
      (8)   The sale shall be conducted without the use of outdoor loudspeakers or other amplification equipment;
      (9)   The sale shall be conducted in accordance with all other laws or ordinances of the city;
      (10)   The license shall be valid only for the particular sale and premises designated in the license and shall be clearly posted in a window of the vehicle so as to be easily seen by the public. The license is nontransferable: and
      (11)   No person, firm or corporation shall be eligible for a used motor vehicle license to conduct the sale of a used motor vehicle more than once during a 24-month period.
   (E)   License application; fee.
      (1)   Application for a used motor vehicle for sale license will be made to the Building Department of the city. The fee for the license will be $10; and
      (2)   No signs advertising the sale shall be affixed to any poles or public property other than the vehicle licensed for sale.
   (F)   Penalties. Any person or entity who shall be guilty of a violation of any of the provisions of this chapter shall be subject to a fine of not less than $75 and not more than $750. A separate offense shall be deemed committed for every day a violation continues. The provisions of this section shall not limit any other remedies authorized by law.
