1305.04 ABANDONED EXCAVATIONS.
   (a)   After demolition of a structure and/or excavation for a new structure, the owner shall begin construction within 60-days following substantial completion of the demolition or excavation so that the excavation is not a nuisance or threat to the health, safety, and welfare of the public. The City Manager or designee may grant a one-time 30-day extension to begin construction if the owner can prove that extenuating circumstances caused a delay beyond the original 60-day time period.
   (b)   If for any reason the owner does not begin construction within the allowable time period, the owner shall immediately cause the abandoned excavation to be filled to the ground surface so that the excavation is not a nuisance or threat to the health, safety, and welfare of the public.
   (c)   If the owner does not satisfy the provisions of subsections (a) and (b) of this section, then the City Manager or designee is authorized to abate the nuisance or threat to the health, safety, and welfare of the public, and charge the cost thereof to the owner of real property of the abandoned excavation as provided in Section 1305.06.
