§ 2.59 ASSESSMENT PROCEDURE.
   (a)   How calculated. Any charge for assessment to be imposed against a benefited by a shall be uniformly imposed as against all benefited .
   (b)   Assessment roll. On or before the first meeting of September of each calendar year, the City Clerk shall present to the City Council the assessment roll for each for the calendar year. Personal notice shall not be required to each of the owners. However, publication of the hearing on the assessment roll shall be advertised in the legal newspaper of the city for at least two publications prior to the hearing on the assessment roll to be accomplished at the first meeting of September.
   (c)   Examination. The City Council shall examine the assessment roll and the assessments. If the Council finds that the assessments are in accord with the estimated costs as presented in the , the Council shall approve the roll and direct the City Clerk to file the assessment rolls for the certified to the County Auditor on or before October 10 of that year.
   (d)   Exception. In the event that the Council finds that the assessment on the assessment roll exceeds the estimated costs and assessments as described in the by more than 10%, the Council shall then direct that notice be given to the owners in accordance with the notice provisions as set forth in § 2.57 of this chapter.
