9-2-3: GROUNDWATER AS POTABLE WATER PROHIBITED:
   A.   Definitions: As used in this section, the following terms shall have the following meanings:
    GROUNDWATER: Water within the earth that supplies wells and springs.
   PERSON: Any individual, partnership, copartnership, firm, company, limited liability company, corporation, association, joint stock company, trust, estate, political subdivision, or any other legal entity, or their legal representatives, agents or assigns.
   POTABLE WATER: Any water used for human or domestic consumption including, but not limited to, water used for drinking, bathing, swimming, washing dishes, or preparing foods. (Ord. 2005-45, 11-28-2005)
   B.   Prohibited:
      1.   Prohibition Near 201 East Lake Street: The use or attempt to use groundwater as a potable water supply by the installation or drilling of wells or by any other method is hereby prohibited from properties within the corporate limits located within a two thousand five hundred foot (2,500') radius area of 201 East Lake Street (the property formerly known as the "Shell Property"), and the adjacent Circle Avenue right-of-way, generally bounded by Sunset Terrace on the north, Glen Ellyn Road on the east, and Freeport Drive on the south, as graphically illustrated in exhibit A attached to the ordinance codified herein, including the use or attempts to use groundwater at points of withdrawal by the Village.
      2.   Prohibition Near 102 East Lake Street: The use or attempt to use groundwater as a potable water supply by the installation or drilling of wells or by any other method is hereby prohibited from properties within the corporate limits of the Village as listed on exhibit B attached to the ordinance codified herein, and as graphically illustrated on exhibit C attached to the ordinance codified herein, including the use or attempts to use groundwater at points of withdrawal by the Village.    C.   Penalty: Any person violating the terms and conditions of this section shall be punishable as provided in section 1-4-1 of this Code. (Ord. 2005-45, 11-28-2005; amd. 2012 Code)
