5-2-1: DEFINITIONS:
As used in this chapter the following words and terms shall have the meanings ascribed to them in this section:
BULK MATERIAL: Any refuse item, not otherwise covered or excluded, that is too large to fit into an approved refuse container and which exceeds fifty (50) pounds in weight. Examples include sofas, large tables and chairs, dressers, bookcases, mattresses and box springs, other large household furniture, and large appliances which do not contain CFC or HCFC refrigerant gas, PCB containing capacitors, mercury switches, or other hazardous components.
CONSTRUCTION DEBRIS: Any waste or refuse collected at premises on which the construction, reconstruction, alteration or remodeling of a building(s) and/or structure(s) is in process and which waste and refuse originates and is derived from such construction processes and operations including paper, cartons, boxes, barrels, wood, packing material made from wood shavings, concrete, brick, lumber, metal, scraps and shavings, and similar materials.
CUSTOMER: Any person, firm, corporation or other entity who owns, leases, occupies, or manages any premises within the village, or who is otherwise responsible for providing for the removal of garbage and/or refuse from said premises, and who is required to obtain garbage and/or refuse removal service by a scavenger as provided in subsection 5-2-2D of this chapter.
E-WASTE: Electronic waste banned from Illinois landfills, including, but not limited to, such items as: TVs, DVD and MP3 players, cellphones, computers, monitors, printers, scanners, laptops, fax machines, game consoles, etc.
GARBAGE: Includes, but is not limited to, food waste, fruit, commonly edible vegetable, animal, fish or fowl matter; food containers of any nature and other material of any nature which is subject to rapid decay, putrefaction and generation of noxious gases or odors and which serve as breeding or feeding materials for insects, rodents or other animals.
HAZARDOUS WASTE: Any material or combination of materials, in any state of matter that poses a threat to public health or the environment by exhibiting characteristics such as: carcinogenic, ignitable, oxidizing, corrosive, toxic, radioactive or explosive, and including such household items as batteries, paints, pesticides, electronics and automotive waste. Hazardous waste as defined by the U.S. resource conservation and recovery act, as amended, or any state or local laws or regulations with respect thereto, or a "toxic substance" as defined in the toxic substance control act, as amended, or any regulations with respect thereto, or any reportable quantity of a "hazardous substance" as defined by the comprehensive environmental response, compensation and liability act of 1980, as amended, or any regulations with respect thereto. The term "hazardous waste" also includes any waste storage, treatment, incineration or disposal that requires a special license or permit from any federal, state or local government entity, body or agency and any substance that is determined to be hazardous or toxic by any judicial or governmental entity, body or agency having jurisdiction to make such determination.
LIQUID WASTE: Waste classified as liquid in accordance with the federal EPA assessment process, to include any waste (excluding hazardous waste and sanitary wastewater) that is liquid at twenty degrees Celsius (20°C) regardless of whether or not it is packaged or otherwise contained, and irrespective of whether or not the packaging or container is to be disposed of together with the liquid that it contains.
PERSON: An individual, firm, company, partnership, or corporation.
PREMISES: Each separate residence, apartment unit, condominium unit, or other dwelling unit, industrial or commercial establishment, motel, hotel, school, church, hospital, club building or meeting hall and every structure or building within the village which is occupied for any purpose.
RECYCLABLE MATERIAL: Materials that have a useful second life in the economic cycle if they are successfully collected, separated, processed, and marketed for return to the economic mainstream. Recyclable materials shall include aluminum cans, tin/steel/bimetal cans, colored and clear glass bottles, HDPE and PET plastic containers, newspaper, magazines, catalogs, telephone directories, corrugated cardboard, chipboard, 6-pack rings, and any other items contractually agreed to. Said materials shall be free of garbage or refuse and stored in a sanitary and healthful manner for purposes of delivering to an authorized recyclable accumulation facility.
REFUSE: Every type of waste material, excluding garbage, recyclable materials, hazardous waste, and any waste prohibited from collection by law. Refuse includes, but is not limited to, debris, appliances, furniture, furnishings and fixtures; and all other material which is not subject to rapid decay or decomposition and which does not serve as breeding or feeding material for insects, rodents or other animals.
SCAVENGER: Any person, firm, or corporation licensed by the village to provide residential and/or commercial garbage and refuse removal services within the village, and as further defined in article A of this chapter.
SOLID WASTE: Refers collectively to garbage, refuse, yard waste, and recyclable materials.
WHITE GOODS: Any domestic and/or commercial large appliance that contains CFC or HCFC refrigerant gas, PCB containing capacitors, mercury switches, or other hazardous components. Examples include, but are not limited to, refrigerators, freezers, air conditioners, ranges (both electric and gas), dehumidifiers, water heaters, furnaces, and other similar large appliances.
YARD WASTE: Consists of both hard landscape (e.g., limbs, branches, or other loose items), and soft landscape (grass clippings, leaves, and plant materials). (Ord. 2012-26, 5-29-2012)
