4-2-22: MINORS:
   A.   Purchase, Possession, Consumption Prohibited: It shall be unlawful for any person under the age of twenty one (21) years to purchase, obtain, possess or consume, except as provided under subsection F of this section, any alcoholic liquor in the village.
   B.   Misrepresentation Of Age:
      1.   It shall be unlawful for any person to misrepresent his or her age for the purpose of purchasing or obtaining alcoholic liquor in any tavern or other place in the village where alcoholic liquor is sold.
      2.   It is unlawful for any person under the age of twenty one (21) years, for the purpose of buying, accepting, or receiving alcoholic liquor from a liquor licensee of the village, to represent that he is twenty one (21) years of age or over, or to present, offer, or possess any false or fraudulent written, printed, or photostat evidence of age or identity, or such identification which is not his own.
   C.   Signs Posted: In every tavern or other place in the village where alcoholic liquor is sold, there shall be displayed at all times in a prominent place a printed card which shall be supplied by the village clerk, which card shall read substantially as follows:
WARNING TO MINORS UNDER THE AGE OF 21 YEARS
Any person under the age of 21 years who, for the purpose of buying, accepting or receiving alcoholic liquor from a liquor licensee of the Village, represents that he is 21 years of age or over, shall be punishable as provided in section 1-4-1 of the Village Code.
   D.   Presence On Premises: It shall be unlawful for any holder of a retail liquor dealer's license, or his or her agent or employee, to suffer or permit any person under the age of twenty one (21) years to sit or stand at a bar counter or the location at or from which a bartender actually prepares or serves alcoholic drinks; provided, that this subsection shall not apply to any such person who is accompanied by his or her parent or legal guardian.
   E.   Sales, Providing To, Permitting Consumption: It shall be unlawful to sell, give or deliver, except as provided in subsections F2 and F3 of this section, alcoholic liquor to any person under the age of twenty one (21) years; and it shall be unlawful for a licensee, his agents, or another person knowingly to allow a person under the age of twenty one (21) years to consume alcoholic liquor.
   F.   Employment:
      1.   No person who is under the age of twenty-one (21) years shall perform service as a bartender or draw, mix or pour any alcoholic liquor within any premises for which a retail liquor license has been issued, except as provided in subsection F3 of this section.
      2.   No person who is under the age of eighteen (18) years shall serve any alcoholic liquor as a waiter or waitress within any premises for which a retail liquor license has been issued.
      3.   Nothing contained in subsections F1 and F2 of this section shall be construed to prohibit persons of the age of eighteen (18) years or older from pouring wine at a table, or pouring, mixing or adding a nonalcoholic beverage to a prepoured or mixed alcoholic liquor beverage; provided such act by a person of the age of eighteen (18) years or older is performed as an incidental act to such person's employment as a waiter or waitress whose primary function is limited to serving food and beverage within premises for which a retail liquor license has been issued; and provided further, that such act does not constitute tending a bar.
      4.   No person who is under the age of twenty-one (21) years shall sell packaged liquor at a retail establishment for which a packaged liquor license has been issued.
   G.   Violations:
      1.   It shall be unlawful for any parent or legal guardian to permit his child or a person under his custody, supervision and control to violate any provisions of this section.
      2.   In addition to all other fines and penalties, the local liquor control commissioner may suspend or revoke the retail liquor dealer's license for any violation of the provisions of this chapter.
