4-2-18: LOCATION RESTRICTIONS:
   A.   Restrictions: No license shall be issued for the sale at retail of any alcoholic liquor within one hundred feet (100') of any church, school other than an institution of higher learning, hospital, home for aged or indigent persons or for veterans, their spouses or children, or any military or naval station; provided, that this prohibition shall not apply to hotels offering restaurant service, regularly organized clubs, or to restaurants, food shops or other places where the sale of alcoholic liquors is not the principal business carried on, nor to the renewal of a license for the sale at retail of alcoholic liquor on premises within one hundred feet (100') of any church or school where the church or school has been established within such one hundred feet (100') since the issuance of the original license. In the case of a church, the distance of one hundred feet (100') shall be measured to the nearest part of any building used for worship services or educational programs and not to property boundaries.    B.   Majority Of Customers Under Twenty One: No license shall be issued to any person for the sale at retail of any alcoholic liquor, except wine and beer, at any store or other place of business where the majority of customers are under the age of twenty one (21) years, or where the principal business transacted consists of schoolbooks, school supplies, food, lunches or drinks for anyone under the age of twenty one (21) years.
   C.   Where Consumption Occurs: Except as specifically authorized in the granting of a license concerning the location of facilities for service and consumption of alcoholic beverages, and applicable special use permits, all service and consumption of alcoholic beverages subject to the provisions of this chapter shall occur only inside a building of a licensed premises.    D.   Location, Screening And Supervision: Video gaming terminals shall be situated in an area restricted to patrons twenty one (21) years of age or older. Said area shall be under direct and constant supervision of an employee of the establishment who is twenty one (21) years of age or older and BASSET certified. The video gaming area shall be screened from view by patrons who are less than twenty one (21) years of age. (Ord. 2014-11, 2-24-2014)
